Primary Legislation Governing Legal Procedures for Foreigners

In Turkey, the legal status and rights of foreign nationals are primarily regulated by the Law No. 6458 on Foreigners and International Protection (LFIP).
All procedures concerning foreigners are carried out by:

  • Provincial Directorates of Migration Management
  • Removal Centers
  • Law enforcement authorities
  • Administrative Courts
  • Criminal Judgeships of Peace

What Is a Deportation (Removal) Decision? How Is It Cancelled?

A deportation decision is an administrative act issued by the Governorships when the circumstances listed under Article 54 of Law No. 6458 are present. In practice, a deportation order is frequently issued when a foreign national is involved in any judicial process.

👉 A lawsuit must be filed within 7 days against the deportation decision.

If an annulment case is not filed before the Administrative Court within 7 days from the date of notification, the decision becomes final.

Once the decision is finalized, the person is removed from Turkey.

Therefore, the deportation process must be followed meticulously by a foreigner law attorney.

What Is Administrative Detention (Removal Center)? How Can It Be Lifted?

Administrative detention means that a foreign national who has been issued a deportation decision may be held in a removal center for up to 6 months. If necessary, this period can be extended by another 6 months.

👉 An objection must be filed with the Criminal Judgeship of Peace within 7 days from the notification.

Following the objection:

  • Administrative detention may be lifted, or
  • Alternative obligations may be imposed (sign-in reporting, address notification, etc.)

What Is a Restriction Code (G and Ç Codes)? How Is It Removed?

Restriction codes may be imposed on foreign nationals for various reasons. These codes may lead to an entry ban or restrict the person’s legal transactions within Turkey.

G-Series Restriction Codes:

  • G-87: Threat to public security
  • G-89: Suspected foreign terrorist fighter
  • G-65: Theft offense
  • G-78: Infectious disease / prostitution
  • G-43: Smuggling offenses

Ç-Series Restriction Codes:

  • Ç-166: Foreign nationals without sufficient means of livelihood
  • Ç-151: Human trafficking / migrant smuggling
  • Ç-149: Attempt to enter a conflict/terror zone
  • Ç-135: Failure to pay administrative fines

👉 Restriction codes may be removed either through administrative applications or by filing a lawsuit.
